These Terms and Conditions (“Terms”) govern your use of appraisal services provided by LaPlante Appraisals and this website. By engaging our services or using this website, you agree to these Terms.

1. Services Provided
Scope of Appraisal Services
LaPlante Appraisals provides professional real estate appraisal services including:
  • Residential property appraisals
  • Luxury and high-value home valuations
  • Pre-listing and purchase appraisals
  • PMI removal appraisals
  • Estate and divorce valuations
  • Market analysis and consulting services
Professional Standards
All appraisal services are performed in accordance with:
  • Uniform Standards of Professional Appraisal Practice (USPAP)
  • Arizona Revised Statutes Title 32, Chapter 36
  • Arizona Department of Financial Institutions regulations
  • Appraisal Foundation standards
2. Nature of Appraisal Services
Opinion of Value
An appraisal is a professional opinion of property value as of a specific date based on market data, property characteristics, and accepted valuation methodologies. It is not:
  • A guarantee of sale price or future value
  • A warranty of property condition
  • A home inspection or structural assessment
  • A prediction of future market trends
  • Financial, tax, or legal advice
Market Conditions
Real estate values fluctuate based on market conditions. Our appraisals reflect market conditions as of the effective date of the appraisal. Values may change due to:
  • Changes in market conditions
  • Economic factors
  • Property modifications
  • Neighborhood changes
  • New comparable sales data
3. Engagement and Assignment Conditions
Engagement Process
Services begin upon:
  • Receipt of signed engagement letter
  • Payment of required fees
  • Provision of necessary property information
  • Intended Use and Users
Each appraisal specifies:
  • The client who engaged our services
  • Intended use of the appraisal
  • Intended users authorized to rely on the report
  • Third parties may not rely on our appraisal reports without our express written consent and potentially an additional fee.
Property Access and Information
Client agrees to:
  1. Provide access to the subject property
  2. Disclose known material defects or issues
  3. Provide accurate property information
  4. Cooperate with the appraisal process
4. Fees and Payment Terms
Fee Structure
Fees are determined by property complexity, scope of work, and intended use
Fees are quoted prior to engagement and must be paid before report delivery
Rush fees may apply for expedited service
Travel fees may apply for properties outside standard service area

Payment Terms
Payment is due prior to or upon report delivery unless otherwise agreed
We accept credit cards, checks, and electronic payments
Late payments may incur interest charges at the rate of 2% per month (18% annually)
Returned checks subject to $35 fee plus any bank charges

Cancellation and Refunds
Cancellations before property inspection: Full refund minus $50 administrative fee
Cancellations after property inspection: Half fee, unless significant work has already been completed
If we cannot complete the assignment due to property access or information issues: Partial refund at our discretion

5. Report Delivery and Ownership
Delivery
Reports are typically delivered via secure electronic transmission within the timeframe specified in the engagement letter. Delays may occur due to:
  • Difficulty accessing property
  • Lack of comparable sales data
  • Client delays in providing information
  • Complex property characteristics
Intellectual Property and Usage Rights
The appraisal report is our intellectual property. Client receives:
  • Right to use the report for its intended purpose
  • Right to distribute to authorized intended users
Client may not:
  • Reproduce or distribute beyond intended users without consent
  • Modify or alter the report contents
  • Use the report for purposes other than specified
  • Separate or excerpt portions of the report from the whole
6. Limitations of Liability
Maximum Liability
To the fullest extent permitted by law, our total liability for any claims arising from our services is limited to the fee paid for the appraisal assignment that gave rise to the claim.

Time Limit for Claims
Any legal action or claim arising from our services must be commenced within two (2) years from:
  • The date of the appraisal report, or
  • The date the client discovered or should have discovered the alleged error
  • Whichever occurs first. Claims not filed within this period are permanently barred.
Disclaimer of Warranties
We provide our professional opinion based on information available and accepted appraisal methodologies. However:
  • We make no warranties, express or implied, regarding property condition
  • We are not responsible for hidden defects or undisclosed issues
  • We do not guarantee any particular outcome or value
  • Market values may differ from our opinion
Excluded Damages
We are not liable for:
  • Consequential, incidental, or punitive damages
  • Lost profits or business opportunities
  • Claims by third parties not intended users
  • Damages resulting from client’s failure to provide accurate information
  • Changes in market conditions after the effective date
7. Professional Compliance and Licensing
Arizona State Licensing
LaPlante Appraisals is licensed by the Arizona Department of Financial Institutions. License information is available upon request and included in all appraisal reports.

Independence and Objectivity
We maintain independence and objectivity in all assignments. We do not accept assignments where:
  • We have a personal interest in the property
  • Compensation is contingent on a predetermined value
  • There is a conflict of interest
  • We cannot provide an unbiased opinion
8. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Arizona without regard to conflict of law provisions.

Venue
Any legal proceedings must be brought exclusively in the state or federal courts located in Maricopa County, Arizona.

Mediation and Arbitration
Before initiating litigation, parties agree to attempt resolution through:
  • Good faith negotiation
  • Mediation if negotiation fails
  • If mediation is unsuccessful, disputes may be submitted to binding arbitration in Phoenix, Arizona, in accordance with the American Arbitration Association rules.
9. Website Terms of Use
Acceptable Use
You may not use this website to:
  • Violate any laws or regulations
  • Transmit harmful or malicious code
  • Attempt unauthorized access to systems
  • Collect user information without consent
  • Interfere with website functionality
Content Accuracy

11. Indemnification
Client agrees to indemnify and hold harmless LaPlante Appraisals from claims arising from:
  • Client’s misuse of the appraisal report
  • Distribution to unauthorized parties
  • Provision of inaccurate information to appraiser
  • Client’s violation of these Terms
12. Entire Agreement and Modifications
These Terms, along with the engagement letter and Privacy Policy, constitute the entire agreement between parties. These Terms may be modified only by:
  • Written agreement signed by both parties
  • Updated Terms posted on this website with notice
  • Continued use after modifications constitutes acceptance of updated Terms.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

14. No Waiver
Failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
